KTSM News – Doña Ana County to enforce short-term rental ordinances next month

EL PASO, Texas (KTSM) — Doña Ana County is notifying property owners with short-term rentals who have not been in compliance could face temporary suspension or cancellation of their permit, the County said in a press release on Tuesday, June 17.

The County says property owners are required to bring their short-term rentals into compliance with the short-term rental ordinance and the new Lodgers’ Tax ordinance by Wednesday, July 16.

The new Lodgers’ Tax ordinance, which was approved back in April, requires short-term rental owners to charge an additional 5 percent tax to renters and remit the tax to the County on a monthly or quarterly basis, the County said.

The County says the short-term rental ordinance, which has been in effect since January 2021, mandates that property owners who rent out their properties through online platforms must complete the following steps.

Property owners must take the following actions within 30 days of this notice:

  • Register with the NM Taxation and Revenue Department to obtain a Business Tax Number, BTN.
  • Apply for a one-time short-term rental permit ($50) and an annual business registration ($35) with the Community Development Department. This registration must be renewed each calendar year with the County Clerk.
  • Submit the following documents to the Community Development Department:
    • Completed short-term rental application
    • Proof of insurance
    • A map showing the location of fire extinguishers and detectors within the home.

Once approved, property owners will be required to notify neighbors within 200 feet of their property via first-class mail about their short-term rental use, the County said.

Failure to meet the requirements or provide proof of cancellation will result in temporary suspension or cancellation of the short-term rental permit, the County said.

Failure to comply with either the short-term rental ordinance or the Lodgers’ Tax ordinance will result in enforcement actions. Owners who choose not to continue offering their properties as short-term rentals may submit proof that they have cancelled their listing with platforms such as Airbnb or Vrbo.

RVs are not permitted to be used as a short-term rental unless they are located within an approved RV park, the County said.
