EL PASO, Texas (KTSM) — A 26-year-old woman was arrested on multiple counts, including DWI, after being involved in two vehicle crashes and refusing to do a traffic stop last weekend in Las Cruces, according to court documents obtained by KTSM.
Desirae Leonor Martinez Aguirre, 26, was arrested on the following five counts:
- Aggravated driving while under the influence of intoxicating liquor or drugs (refused testing)
- Resisting, evading or obstructing an officer (refusal to stop)
- Reckless driving
- Leaving the scene of an accident (property damage)
- Driver’s license not in possession
Martinez Aguirre was booked into the Doña Ana County Detention Center without incident.
At around midnight on Sunday, Sept. 28, an officer with the New Mexico State Police was assisting traffic control at the intersection of Mountain Vista and Crawford Boulevard. There was heavy traffic traveling northbound on Crawford.
The deputy saw a pickup truck traveling eastbound on Robert Larson Boulevard, approaching the intersection “at a high rate of speed.” The vehicles traveling eastbound stopped at a stop sign, according to the court documents.
“Approached from behind, swerved and failed to stop at the intersection, swerving into the traffic and impacting another vehicle at the intersection,” according to court documents. The deputy attempted to conduct a traffic stop, but the truck did not stop and continued to travel eastbound at a high rate of speed, coming to the end of the pavement, according to the court documents.
The truck then turned around and headed westbound, going towards the deputy. The deputy then conducted a felony stop.
According to court documents, the driver was identified as Martinez Aguirre through her Social Security Number, since she did not have her license.
Martinez Aguirre was arrested and placed in the patrol vehicle. The deputy noted that as he was placing Martinez Aguirre in his patrol unit, he “smelled a strong odor of alcoholic beverages” coming from her breath. The other two people in the truck were also detained.
Martinez Aguirre admitted to the deputy that she did drink alcoholic beverages at Chilitos, then drove to the Fair Grounds, where she drank more.
During the investigation, it was revealed that the front passenger was initially driving when they left the fairgrounds. She rear-ended another vehicle, then Martinez Aguirre jumped into the driver’s seat and left the scene, leading to the second crash at the intersection. It is noted in the court documents that Martinuez Aguirre did not notice that she had crashed into a vehicle at the intersection.
According to court documents, Martinez Aguirre refused to provide a breath sample for the Field Sobriety Tests and refused the New Mexico Implied Consent Advisory. Martinez Aguirre had no previous arrests for DWI.
