EL PASO, Texas (KTSM) — A New Mexico Jersey Mike’s franchise owner is dead following a rollover crash early Saturday morning, Oct. 4, in the Town of Mesilla, according to the Mesilla Marshal’s Office.
At around 2:30 a.m. on Saturday, deputies were dispatched after a 911 call informed them that a single vehicle had crashed in a park owned by the Town of Mesilla.
When deputies arrived, they found a white BMW near a water fountain with the driver inside.
The Mesilla Marshals Traffic Investigators determined that the BMW was traveling southbound on Calle De El Paso, approaching Calle Pacana, when the driver failed to turn in the curve, struck the curb and flew airborne into the park. The car overturned three times on the lawn before it came to rest upright near the water fountain.
Investigators also said the BMW was travelling “at a high rate of speed, exceeding the posted speed limit of 35 mph.”
The driver and sole occupant of the vehicle was identified as David Leyva. It was also noted by investigators that Leyva was not wearing a seatbelt.
The Mesilla Fire Department arrived at the scene to conduct life-saving measures, but Leyva died due to his injuries inside the ambulance, according to the Mesilla Marshal’s Office.
Additionally, the Medical Examiner investigator pronounced Leyva dead at the scene and he was transported to the Albuquerque Office of Medical Examiners. Toxicology results will be sent to the Traffic Investigator at a later date.
Leyva was a franchise owner of Jersey Mike’s restaurants in Albuquerque and Santa Fe. Leyva was visiting the Las Cruces Jersey Mike’s location, according to the general manager of the Las Cruces restaurant.
