EL PASO, Texas (KTSM) — A trial date has been set for El Paso County’s challenge of the State of Texas’ controversial law authorizing local police to arrest and deport undocumented migrants.
Senior U.S. District Judge David Alan Ezra set a July 8 trial date in the County’s suit over the legality of SB 4, the El Paso Times reported.
The lawsuit was originally filed in December 2023 by the U.S. Justice Department, El Paso County, Las Americas Immigrant Advocacy Center and others.
The trial will take place in Austin, the El Paso Times reported.
Defendants in the lawsuit are the State of Texas, Gov. Greg Abbott, the Texas Department of Public Safety and former DPS Director Steven C. McGraw.
The trial date comes as an appeal over a judge’s ruling to issue a preliminary injunction preventing the law from going into effect remains pending in appeals court.
Another big question hanging over the lawsuit is whether the U.S. Justice Department will remain part of the suit under the Trump Administration.
