Texas’ Immigration Law On Hold Again: Texas cannot enforce its controversial immigration law while courts review its constitutionality, an appeals court ruled late Tuesday. A three-judge panel of the 5th Circuit Court of Appeals upheld a lower court injunction that barred the state from enforcing the law, known as Senate Bill 4, that allows local police to enforce immigration laws and potentially deport people believed to have entered the country illegally.

The injunction replaces an administrative stay the same judges issued last week after the U.S. Supreme Court urged the 5th Circuit to move more swiftly in hearing the case.

The three judges, who voted 2-1 to uphold the injunction, have scheduled an April 13 hearing on SB 4. The majority opinion Tuesday, written by Chief Judge Priscilla Richman, strongly indicated that the judges would eventually side with El Paso County and the other plaintiffs who say the Texas law is unconstitutional.

“For nearly 150 years, the Supreme Court has held that the power to control immigration — the entry, admission and removal of noncitizens — is exclusively a federal power. Texas has not shown that it is likely to succeed on the merits,” Richman wrote.

The legality of SB 4 is likely to eventually be determined by the Supreme Court.

John Hadjimarcou, Dean of the Woody L. Hunt College of Business

UTEP Names New Business Dean: The University of Texas at El Paso has named John Hadjimarcou as dean of the Woody L. Hunt College of Business starting April 1. He has served as interim dean since August 2023 following the departure of James Payne earlier that summer. “I am honored and thankful for this opportunity to lead our college forward,” said Hadjimarcou, who joined UTEP in 1994 as an assistant professor of marketing. He has served as chair of the Department of Marketing, Managements and Supply Chain and is the Endowed Chair for the Center for the Study of Western Hemispheric Trade. He received the Faculty Achievement Award for Teaching from UTEP in 2010 and the University of Texas System Regents’ Outstanding Teaching Award in 2013. Hadjimarcou earned his Ph.D. in marketing with a minor in international business from Kent State University in Ohio, and his bachelor’s and master’s in business administration from West Virginia University.

New Federal Judge: U.S. Magistrate Leon Schydlower has been confirmed as a new U. S.  District Court Judge for the Western District of Texas, which stretches from San Antonio to El Paso. He will be a judge in the federal courthouse in El Paso. Schydlower was confirmed by the Senate on March 22. He will fill the judicial seat left vacant by U.S. District Court Judge Philip Martinez, who died in 2021. Schydlower has been a federal magistrate in El Paso since 2015. He graduated from Hanks High School in 1989 and earned his bachelor’s degree from the University of Texas at Austin in 1993. He graduated from the University of Texas School of Law in 1995.
