On March 20, 2026 I submitted a public information request to the City of El Paso asking for “a complete list of approved and pending incentive agreements to lure companies to El Paso for the period between January 7, 2025 and the present.”
Mayor Renard Johnson promised to bring industry to El Paso and I want to know what, if anything, he has achieved.
On April 3, Senior Assistant Attorney Juan Gonzalez wrote to Texas Attorney General Ken Paxton to ask whether “certain requested information is exempted from release.”
On June 11, the Office of the Attorney General responded to Gonzalez ordering the City of El Paso to release to me the documents I requested.
Then on June 22, the City of El Paso filed a lawsuit against Attorney General Ken Paxton to prevent me from receiving the documents. Their Original Petition for Declaratory Relief seeks to “withhold from release documents detailing updates on economic development negotiations between companies and the City of El Paso,” claiming the documents are excepted from disclosure under the Texas Government Code.
On July 6, the lawsuit was brought before City Council in Executive Session under item EX2, with all eight city representatives approving the legal action.
I have been requesting and acquiring public records from local taxing entities for more than a dozen years but this is the first time a lawsuit has been filed to prevent me from receiving information to which I am legally entitled.
Apparently the City is willing to spend tens of thousands of dollars on attorneys, and potentially millions of dollars, to prevent me from learning something they do not want me to know.
We shall follow the litigation closely.
