On January 19 the City of El Paso filed a motion with the Texas Supreme Court to dismiss its petition for review, and I did not file a cross-petition for review nor did I oppose the motion.
On Friday, January 27, the Texas Supreme Court issued an order granting the City’s Unopposed Motion to Dismiss and dismissed the petition for review in Case No. 21-1105.
Thus, the ruling of the 8th Court of Appeals in case no. 08-19-00272-CV stands.
In addition to issuing its order, the Texas Supreme Court sent the attached notice of its order to all 11 attorneys involved in the litigation:
