KTSM News – County reminds public of interference with child custody orders ahead of the holidays

Posted on November 25, 2024

EL PASO, Texas (KTSM) — As the holidays are upon us many children will be splitting their time spent with their parents with court-ordered judicial arrangements and the El Paso County Domestic Relations Office is reminding the public of the civil penalty recently passed for the custodial interference county order.

On Sept. 16, El Paso County Commissioners unanimously approved the county civil penalty for interference with a child custody order, which is a new measure to enhance the family court’s ability to address violations of court orders concerning child custody, according to the County.

The county order allows the County office to request a fine of up to $500 from the family courts for interfering with a child custody order.

The County says custody interference includes withholding a child from another parent against the terms of the court order.

“Interference with child custody is a criminal offense in Texas punishable by up to two years in state jail and a fine of up to $10,000. However, some police departments consider the issue to be a civil matter and outside the scope of their work, leaving the parent with little recourse,” the County said.
