EL PASO, Texas (KTSM) — A 21-year-old man was arrested for the alleged shooting death of his wife’s uncle after a dispute over infidelity on Sunday, Nov. 2, in an East El Paso apartment complex, according to court documents obtained by KTSM.
As KTSM 9 News previously reported, 21-year-old Jaeveyin Antonio Porter was charged with murder for shooting and killing 36-year-old Miguel Garcia, according to the El Paso Police Department (EPPD).
On Sunday morning, officers responded to a shooting at the 7900 block of Viscount, La Estancia apartment complex. Upon arrival, they found a male victim, later identified as Garcia, outside the apartment on the second floor with apparent gunshot wounds. Fire Medical Services personnel arrived at the scene, and Garcia was pronounced dead, according to court documents.
A description of the suspect, later identified as Porter, was put out over law-enforcement radio, and he was located and detained shortly after at the 1100 block of Sunmount. Porter said that his vehicle was in the parking lot and that the gun was inside the car in the center console.
The woman who reported the incident, and whom Porter identified as his wife, met with detectives and stated that she and Porter began arguing on Friday, Oct. 31, due to accusations of infidelity. She said that the argument carried on until Sunday, when she later left the apartment to meet her family at church, according to court documents.
According to court documents, the woman said that while she was driving to church, Porter and she were still communicating via cellphone. She said that she began to drive back towards the apartment, and on the way, she picked up Garcia and told him that she wanted his help in asking Porter to leave the apartment.
The woman said that when they arrived, she told Porter that she was not alone. She then attempted to use her key to open the apartment, but was unsuccessful because Porter had locked all the locks on the door. She proceeded to call Porter on his cellphone to open the door calmly while she was outside. Porter told her that he knew Garcia was also there with her and didn’t open the door. The woman said she and Garcia were at the front door for around four to five minutes, according to court documents.
She then asked Garcia to force the door open so she could enter the apartment since she is also on the lease. Garcia began to use his shoulder and body weight to open the door until it opened. Once the front door was open, the woman saw Porter coming down the stairs of the apartment and began shooting towards Garcia. She added that she heard around four shots and that Porter exited the apartment and continued to shoot at Garcia. Porter then left the scene on foot with the handgun still in his hand, according to court documents.
Officers met with Porter, who said he and his wife had been arguing since Oct. 31 because he was being accused of infidelity, and that the argument continued to the morning of Sunday.
Porter confirmed that his wife left the apartment to meet her family at church and that while he was at the apartment, she kept communicating with him that she wanted him out of the apartment and that she was on the way back with her uncle, Garcia. Porter said that he told his wife that he would let her in if Garcia left. However, Porter then heard the door being struck multiple times and said he grabbed his cellphone to record what was happening. He added that he did not call 911 for assistance and ended the interview, according to court documents.
According to court documents, two witnesses provided statements and said that they could hear the woman asking Porter why he shot Garcia, to which Porter stated, “I don’t give a f***” or “I don’t f****** care.”
Another witness said she saw Garcia at the door yelling, asking someone to open the door in Spanish. She then observed Garcia break the door down with his shoulder, and once the door was open, she then heard around eight gunshots.
Investigators located evidence at the scene consistent with statements provided by those involved and witnesses, including multiple bullet casings, projectiles, and suspected blood. All evidence indicated that a shooting had occurred, according to court documents.
