EL PASO, Texas (KTSM) — Attorneys and the family of the 14-month-old boy who was killed in a high-speed crash involving a Luna County Sheriff’s deputy last year near Deming will hold a news conference this week to address the next steps regarding the civil suit that was brought following the baby boy’s death, Tawney, Acosta & Chaparro P.C. announced in a news release.
The news conference will be held at 1 p.m. Thursday, Nov. 14 at 7016 Orizaba Ave.
On Sunday morning, Nov. 11, 2023, Isabella Hernandez and her 14-month-old son Wyatt Franzoy were headed home in a Nissan Altima when they were T-boned by Paul Garcia, a deputy with the Luna County Sheriff’s Office, according to the law firm.
The law firm said Garcia was driving a marked, department-issued 2021 Dodge Durango and going 99 miles per hour at the time of the impact.
Hernandez and her son were less than a mile away from their home., according to the law firm.
According to Sheriff’s Office reports, both vehicles were headed south on Columbus Road when Garcia attempted to pass Hernandez via the northbound lane in a “no pass” zone while she was turning east onto Voorhies Road into a residential area.
The impact was so violent it “launched the Nissan across the highway and sent the sedan spinning nearly 200 feet into a nearby resident’s fence,” according to the law firm.
“The crash caused the wrongful death of 14-month-old Wyatt Franzoy who was pronounced dead at Mimbres Memorial Hospital,” the news release said. “Officer Garcia’s negligence has forever altered the lives of the Hernandez and Franzoy families, who’ve fought for over a year for accountability from Luna County officials and justice for baby Wyatt.”
