LAS CRUCES, N.M. (KTSM) — A 27-year-old woman has been sentenced to 10 years in prison in connection with a fatal DWI crash that resulted in the death of a bicyclist back in February 2024 in Las Cruces, according to the Third Judicial District Attorney’s Office (Doña Ana County).
Initially, the District Attorney’s Office requested a 15-year sentence for Emily Elizabeth Portillo, 27, “emphasizing the need for accountability in impaired driving cases.”
However, Portillo was ultimately sentenced to 10 years in prison, with seven years to be served in custody and three years suspended, the District Attorney’s Office said.
As KTSM previously reported, on Feb. 29, 2024, Roy Parra, 47, was riding a mountain bike and pulling a small bicycle trailer on the sidewalk of Lohman Avenue.
According to the Las Cruces Police Department (LCPD), when Parra was crossing over I-25, he was struck by Portillo’s vehicle.
Parra was transported to UMC and died two days later, LCPD said.
The District Attorney’s Office said speeding and driving while under the influence of both alcohol and cannabis were contributors to the crash.
“This case is a tragic reminder that one irresponsible decision to drink and drive can cost lives and shatter families,” Senior Trial Attorney Richard Wellborn said. “We hope this sentence sends a clear and strong message to all New Mexicans: drinking and driving has serious consequences.”
During the sentencing hearing, statements from both Parra’s and Portillo’s families were delivered in court.
“New Mexico continues to face a troubling rise in DWI-related deaths,” DA Fernando Macias said. “The tragic loss of Roy Parra reflects that reality. The public needs to know that we will pursue incarceration for any impaired driver — under the influence of alcohol or drugs — who causes the death of another person. Our office remains committed to ensuring they are held fully accountable under the law.”
